A federal judge rejected a joint request by Gemini and the CFTC to undo their settlement, despite the regulator’s reversal on bringing the case.

Judge Alvin Hellerstein declined on Oct. 15, 2026, to set aside a $5 million settlement between cryptocurrency exchange Gemini and the Commodity Futures Trading Commission, according to Bitcoin.com News.
The CFTC had joined Gemini in seeking to overturn the agreement after determining that it should not have brought the original lawsuit.
The ruling leaves the settlement unchanged despite both parties’ request. Gemini’s already-paid penalty and the permanent injunction remain in effect.
