CFTC Event-Contract Rules Leave State Gambling Questions Open
Edited by Steinar Vigdel Kolnes, Editor, Oslo
A proposed swap definition, an adopted casino-wager exclusion and divided courts leave distinct legal questions for US event contracts.

US event-contract regulation involves several separate developments: a proposed change to the swap definition, an adopted casino-wager exclusion and conflicting court views on state gambling laws, according to The Defiant.
The swap-definition proposal and the casino-wager exclusion are at different stages. The former remains a proposal, while the latter has been adopted, giving the two measures different legal significance.
Courts are also split over the role of state gambling laws in event-contract markets. That unresolved issue is separate from the CFTC’s rule changes and remains part of the broader legal debate.
